Fearless Fund Next Steps

Session Description: In the wake of last year’s Supreme Court decision ending Affirmative Action in higher education, numerous lawsuits have been filed targeting grantmaking and nonprofit programs that aim to advance racial equity, with the Fearless Fund case being a prime example. Many in philanthropy have expressed concern about the potential chilling effect these lawsuits could have on charitable sector work supporting and advocating for vibrant, healthy, and equitable communities. This briefing will feature important discussions, action items and include the following:

  1. Opportunities for PSOs to collaborate with sector leaders and advocates in support of strategic legal actions, communications and messaging campaigns, and legislative advocacy work.
  2. Key details about the possible effects this and similar lawsuits could have on sector programs that seek to advance racial equity and justice.
  3. Potential legislative solutions, regulatory avenues, and sector mobilization efforts to counter these regressive trends and bolster philanthropic and nonprofit racial equity initiatives.
