Session Description: During this session, Byron McLain, Von Bryant, and Kel Thomas (attorneys at Foley & Lardner LLP) will speak about the implications of recent court cases on the ability of foundations to continue their scholarship funding efforts as currently structured. These attorneys have tracked the litany of cases targeting Affirmative Action, public & private sector DEI efforts, and public and private grants and scholarships for underserved communities. Specifically, they have analyzed and reviewed the Fearless Fund case, with a specific lens toward its unique consequences on the state of private charitable giving. In their individual practices, they represent efforts to bolster the economics of marginalized communities through impact funds and they also lead litigation to counter economic racial discrimination.
